OCCUPATIONAL SAFETY AND HEALTH
Under the Health and Safety in Employment Act 1992 (as amended in 2003) and the 1995 Regulations, the duties imposed upon employers, owners of a place of work, those in control of a place of work, the self-employed, contractors, etc have become more onerous. The fines in this area are increasing under the new maximum levels as are the relevant obligations, especially for employers.
Our specialist team has been involved in health and safety from the very beginning, and in fact were defence counsel in the seminal health and safety in employment law case -- Department of Labour v de Spa & Co. We advise clients on their obligations under the health and safety legislations (including employee participation systems), health and safety management, how to deal with OSH inspectors and help them prepare health and safety policies, Our involvement also extends to negotiations and meetings with the Department of Labour (Occupational Safety and Health Inspectors) and representing clients at both the District and High Courts in respect of defended hearings and guilty pleas.
