New privacy laws come into force in December

New privacy laws are now set to come into force on 1 December 2020 following the Privacy Bill passing through its final stage in Parliament.  The Bill, which replaces the Privacy Act 1993, passed its third and final reading in Parliament on Friday 26 June.

The key change for most businesses under the new regime will be the requirement to report on serious privacy breaches.  For an overview of the breach reporting requirement and the other key changes under this new law, please read our earlier newsletter, which can be found here.

With the date for the new law now confirmed, it is a great time to review your privacy policies and processes to ensure they are up to date.  If you would like to understand more about new law, and how it may impact you, please get in touch with us.

There is also one other small update on privacy in relation to Covid-19 contact tracing to mention.   This is that the Order requiring organisations to keep certain records to enable contact tracing expired when New Zealand moved to alert level 1.  So, there are no longer any specific requirements on organisations to keep records for contact tracing, although the Government is asking organisations to support its Covid-19 App by providing the posters for users of the App to scan when visiting an organisation’s premises
